Terms of Service

By accessing or using Gifty, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use Gifty. If you use Gifty on behalf of someone else or an organization, you confirm you are authorized to accept these Terms on their behalf.

You must be at least 18 years old and able to enter into a binding contract to use Gifty. By using Gifty, you represent that you meet these requirements and that the information you provide is accurate and complete.

You sign in to Gifty using your phone number and a one-time verification code. You are responsible for keeping access to your phone and account secure, and for all activity that occurs under your account. One account per person; do not share your account or impersonate others. Notify us promptly of any unauthorized use.

Gifty lets you buy products and gift cards from local stores and partners. Product descriptions, images, and availability are provided to help you choose, but may vary and are not guaranteed to be error-free. Placing an order is an offer to purchase; an order is confirmed once payment is authorized (or, where offered, cash on delivery is accepted). We or a store may decline or cancel an order — for example if an item is unavailable, mispriced, or a payment cannot be verified — in which case you will be refunded for any amount charged.

Prices are shown in US Dollars (USD) unless stated otherwise and may include applicable fees. You authorize us and our payment providers (Areeba and Whish Money) to charge your selected payment method for the total shown at checkout, including any delivery fee. You are responsible for providing valid payment details. If a payment fails or is reversed, we may cancel the related order.

Gift-card and wallet-funded purchases: where credits or a wallet balance cover part or all of an order, the remaining amount is charged to your chosen payment method.

Gifty gift cards are digital and are issued after payment is confirmed. They can be redeemed toward purchases on Gifty in accordance with any stated value, currency, and expiry. Gift cards are not reloadable unless stated, cannot be exchanged for cash except where required by law, and should be treated like cash — we are not responsible for lost, stolen, or misused codes shared by you or a recipient.

Your Gifty wallet may hold credits earned through promotions, referrals, refunds, or redeemed gift cards. Credits and wallet balances are personal to you, are non-transferable, have no cash value except where required by law, and may be applied to eligible purchases as described in the app. We may adjust, expire, or revoke credits obtained through error, fraud, or violation of these Terms.

We deliver to supported areas within Lebanon. Delivery times, fees, and free-delivery thresholds are shown at checkout and may vary by location, store, and demand. You are responsible for providing accurate recipient and address details. If a recipient is unavailable or details are incorrect, delivery may be delayed and additional fees may apply.

Because many gifts are prepared, personalized, or perishable, cancellations and returns may be limited once an order is being prepared. Where an order is cancelled by us or a store, or an item cannot be delivered, you will be refunded — typically to your Gifty wallet — for the affected amount. For questions about a specific order, contact support.

You may submit special requests for custom gifts, including images and a description. Our team reviews requests and may respond with an offer, including a price and estimated delivery time. A special request becomes an order only when you accept the offer and complete payment. We may decline requests at our discretion.

We may offer referral rewards, promo codes, and other promotions, each subject to its own rules. Promotions are for personal, non-commercial use, cannot be combined unless stated, and may be changed or ended at any time. We may withhold or reverse rewards obtained through abuse, self-referral, fake accounts, or other violations of these Terms.

You agree not to:

• Use Gifty for any unlawful, fraudulent, or harmful purpose.
• Provide false information, impersonate others, or send gifts to people without a lawful basis to use their details.
• Interfere with, disrupt, or attempt to gain unauthorized access to Gifty, its systems, or other users' accounts.
• Scrape, copy, or misuse our content, catalog, or services, or bypass usage limits and security measures.
• Upload content that is illegal, offensive, infringing, or violates others' rights.

You are responsible for the content you provide, including gift messages and images for special requests. You confirm you have the right to share it. You grant Gifty a limited license to use this content solely to provide and improve our services (for example, to fulfil your request and deliver your gift). We may remove content that violates these Terms.

Gifty, the Gifty name and logo, and all software, design, and content we provide are owned by Mercator or our licensors and are protected by law. We grant you a personal, limited, non-exclusive, non-transferable license to use Gifty for its intended purpose. You may not copy, modify, distribute, or create derivative works from our platform without our permission.

Gifty features products from independent stores and may contain links to third-party services. We are not responsible for the products, content, or practices of third parties. Your dealings with them are between you and them, subject to their terms.

Gifty is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that Gifty will be uninterrupted, error-free, or that gifts will always arrive at a specific time, particularly where delays are caused by stores, delivery partners, or events beyond our control.

To the fullest extent permitted by law, Gifty and Mercator will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

You agree to indemnify and hold harmless Gifty, Mercator, and our partners from any claims, losses, or expenses arising from your misuse of Gifty, your violation of these Terms, or your infringement of any law or third-party right, including the improper use of a recipient's information.

We may suspend or terminate your access to Gifty, remove content, or cancel orders if we reasonably believe you have violated these Terms, engaged in fraud or abuse, or created risk for Gifty or others. You may stop using Gifty and delete your account at any time. Provisions that by their nature should survive termination will continue to apply.

These Terms are governed by the laws of Lebanon, without regard to conflict-of-law rules. You agree that the competent courts of Beirut, Lebanon will have jurisdiction over any dispute arising from these Terms or your use of Gifty, subject to any mandatory rights you have under applicable law.

We may update these Terms as Gifty evolves. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of Gifty after changes take effect means you accept the updated Terms.
